Appeal Success in Ashover, Derbyshire
Another appeal success for Spawforths. Spawforths has advised Marsh Green Estates Ltd on its successful planning appeal for residential development at land at the Junction of Narrowleys Lane and Moor Road, Ashover, granted following a Public Inquiry in May 2016.
The site lies on the edge of the village of Ashover and was recovered by the Secretary of State for determination. The Secretary of State concluded in allowing the appeal that substantial weight should be given to the contribution the “appeal scheme would make to helping to achieve the Government’s aim of boosting the supply of housing in a district where the supply of suitable housing sites is heavily constrained and there is a clear need for more market and affordable housing to be delivered, with a particular need for more market and affordable housing in the village of Ashover”.
In terms of landscape impact the Secretary of State agreed that the appeal site is in a visually sensitive location and, whilst not subject to any national landscape designation, is part of a valued landscape. However, he gave this issue moderate weight in the planning balance citing the potential to design a sensitive extension to Ashover.
